Authorities say Noel Powell III, of Lawrence, N.J. was taken into custody in Trenton, Sunday afternoon, November 19.

Powell is facing multiple charges, including murder.

The shooting happened shortly after midnight November 14.

Investigators say Powell approached a lone male sitting at the bar and fired a weapon. Lawrence Township police responded to the scene. Police identified the victim as 23-year-old Devin Smith. His friends told FOX 29 he is the father of a 3-year-old girl.

"They saw an individual suffering from an apparent gunshot wound to the head. The individual is a male in his early to mid 20's," Mercer County Prosecutor Angelo Onofr said.

Throughout the early morning, police could be seen moving in and out of the restaurant. Tape cordoned-off the parking lot shared with a Dunkin' Donuts open for business.

The prosecutor would not answer questions offering only a description of the victim and attacker.

"Suspect is described as a black male in his mid-20's. He exited the Appblebee's and entered a dark colored van," Onofri said.

Applebee's a national chain out of Kansas City, Missouri, with a motto of: "There's no place like the neighborhood" in a statement wrote: "We offer our condolences to the family of those impacted. The safety and security of our guests and team members is paramount."
